If the answer to these questions is ‘yes’ (and it is), then no discrimination is taking place. This should be the end of the discussion, but it never is. The Supremes have discovered something they call ‘chilling effect’, which appears nowhere in the Constitution, and based many decisions on this.
Oklahoma should have declined to show up at the trial and informed the world that the United States has no subject-matter or geographical jurisdiction within Oklahoma on this issue, and then simply ignore the court’s decision. Obama would surely have raised the bet, but as long as a state — Oklahoma in this case — continues to see and call, the pressure is always on the US and they must eventually either fold or try some brutal tactic, such as they did in the Elian Gonzales case. Jeb Bush is not the governor of Oklahoma, so that tactic might backfire as well.

Exactly, Arizona should have done just that when the federal Judge ruled on their recent Illegal Immigration Law. Notwithstanding the fact that the judge’s decision was absurd, the federal judge had no jurisdiction in the matter whatsoever. States need to start reclaiming/exercising their rights against this pattern of meddling and abuse by federal courts.

I think it offers a good place to start the conversation. It is a fair representation of the vast left-wing lunacy. They keep choosing the wrong compromises, albeit sometimes just in degrees. They are first-order perturbations to a system which is already dynamically stable. It is the resulting societal disruption, left-wing societal change, or left-wing inflation, which poses an imminent threat to individual dignity and the shared, peaceful space otherwise referred to as society.

The only “natural born citizen” case that I thought that the courts would have to admit had standing was Alan Keye’s, since he was on the ballot in CA in 08. Does anyone know if that one is still alive? If it is the next step should be the discovery phase which should be very interesting.
