Sotomayor’s Just-Us Overtured

Supreme Court nominee Sonia Sotomayor awaits her first senatorial meeting of the day, Tuesday, June 23, 2009, on Capitol Hill in Washington. (AP Photo/Harry Hamburg) (Harry Hamburg - AP) Everyone was starting to get a bit nervous when Obama’s Justice Department let the Panthers get away with voter intimidation. It was starting to look like the two-tier, racial payback era had begun. Now while we can celebrate now that justice is colorblind, let’s see if the very person whose decision was overturned today, will be the person who unevens the playing field tomorrow…

The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.

New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities.

The ruling could alter employment practices nationwide, potentially limiting the circumstances in which employers can be held liable for decisions when there is no evidence of intentional discrimination against minorities.

Let’s see how frantic the White House is now to get Sotomayor appointed. Then again, Obama can always go the executive order route, that is, if he has the guts.

Why would no African-Americans and only two Latinos be given promotions? In relation to how many on the force? Does the test have questions on it that discriminate against minorities, or is it simply a matter of whoever passes gets the promotion, regardless of race? If it’s the latter, then obviously the decision by the Supreme Court is not only justified, but should be incontrovertable, especially if we now live in an age of “racial blindness.”

The dissenting opinion mentioned “equality of opportunity” in relation to the case. I say it has nothing to do with equality of oppurtunity and everything to do with the left’s intent to establish equality of outcome, which, by definition, is totalitarianism.

    How about this from Ginsburg:

“[The white firefighters] understandably attract this court’s sympathy. But they had no vested right to promotion.”

Well if they had no right to promotion after passing all the requirements then who exactly WOULD have a vested right to promotion? According the the City and the lower Courts it would be ONLY minorities who passed all the requirements. Nope, no discrimination there…

Igor, you are absolutely right. Their sleight of hand knows no bounds.

Finally, some good news. (keep it coming)

Too bad for Sonia “part of the problem” Sotomayor, this is one battle won for the good people of America. Let’s hope that the adults will continue to keep the “children” in check.

They’ll try to have her appointed late late late on a Friday afternoon when the MSM and others aren’t watching.

That, or when another celeb dies and all the attention is elsewhere.
